General terms and conditions for internet use

 

Unless explicitly agreed otherwise between Lumen Homes and the guest in writing, the following terms and conditions apply to every booking:

  • The General Terms and Conditions
  • The house rules
  • The General Terms and Conditions for Internet Use (apply when using the Lumen Homes WiFi network)


General Terms and Conditions


Preamble
In the following general terms and conditions, the term ‘guest’ or ‘customer’ refers to any natural or legal person who may use the services of Lumen Homes.

I. Scope of application
1. these terms and conditions apply to contracts for the temporary rental of rooms for accommodation for a fee (hereinafter referred to as ‘rooms’ or ‘room’) and to all other services offered by Lumen Homes to the guest.
2. any subletting or re-letting of the rooms provided and their use for purposes other than accommodation requires the prior written consent of Lumen Homes. The rooms may only be used for the agreed period. A tacit extension of the contract by mere continued use is excluded.
3. the guest's general terms and conditions are only valid if this has been expressly agreed in writing in advance.
4. The house rules of Lumen Homes and the General Terms and Conditions for Internet Use must be observed and form part of these Terms and Conditions.

II. Conclusion of contract and contractual partner
1. the accommodation contract is concluded when the guest submits a booking request (application) for a certain number of persons, which can be accepted by Lumen Homes and if other conditions formulated in the application, offer or acceptance letter from Lumen Homes are fulfilled (e.g. making an advance payment). A change in the number of persons booked is only possible with the consent of Lumen Homes. Direct enquiries to Lumen Homes and also bookings via booking portals are deemed to be applications.
2. lumen Homes may confirm the booking (acceptance) in text form or choose a form other than written form at its own discretion.
3. the contracting parties are Lumen Homes and the guest. If a third party books the accommodation/rooms for the guest, this third party shall be jointly and severally liable with the guest to Lumen Homes for all obligations arising from the accommodation contract.

III. Services, prices, payment, guest's right of cancellation
1. Lumen Homes undertakes to make the booked rooms available to the guest and to provide the agreed additional services. The full accommodation price will be charged for each overnight stay, regardless of the actual use or presence of the guest.
2. the guest may book additional accommodation services at any time. The prices for these additional services are listed in the current offer letter from Lumen Homes. These additional services can only be booked in conjunction with accommodation at Lumen Homes.
3. the guest is obliged to pay the prices incurred by Lumen Homes for the provision of the rooms and the additional services used. This also applies to additional services and expenses incurred by Lumen Homes vis-à-vis third parties at the guest's request. The prices of Lumen Homes include the applicable value added tax. Lumen Homes is entitled to demand an advance payment of the total amount for all overnight stays and the cleaning fee upon or after conclusion of the contract. This advance payment must be transferred to the bank account specified by Lumen Homes within the period stated in the application, offer or invoice. Lumen Homes may issue interim invoices for additional services provided by itself or third parties, which are due immediately. In justified cases, such as late payment by the guest, Lumen Homes may refuse to provide further services.
4. the reserved rooms are accessible to the guest on the day of arrival from the check-in time specified in the house rules. On the day of departure, the rooms are available to the guest until the check-out time specified in the house rules.
5. the guest may withdraw from the contract within the cancellation periods specified in the application, offer or letter of acceptance. In the event of withdrawal by the guest, Lumen Homes is entitled to retain the advance payments made in accordance with the specified cancellation deadlines. Cancellation must be declared by the guest to Lumen Homes in writing. Cancellation via the booking portal with which the booking was made shall be deemed equivalent to written notification of withdrawal. In this context, Lumen Homes draws attention to the possibility of taking out travel cancellation insurance, travel interruption insurance or international health insurance to cover any repatriation costs in the event of travel interruption due to accident or illness, as well as travel accident or luggage insurance.

IV. Liability of Lumen Homes
1. lumen Homes shall be liable for damages caused by injury to life, body or health, insofar as lumen Homes is responsible for these. In addition, Lumen Homes shall be liable for other damages caused by wilful or negligent breach of material contractual obligations. Essential contractual obligations are those that make the proper execution of the contract possible in the first place and on whose compliance the guest may rely. A breach of duty by Lumen Homes is equivalent to a breach of duty by its legal representatives or vicarious agents. Further claims for damages are excluded, unless otherwise regulated in this section IV.
2. if disruptions or defects occur in the services of Lumen Homes, Lumen Homes will endeavour to remedy the situation after becoming aware of them or after an immediate complaint by the guest. The guest is obliged to make a reasonable contribution to remedying the disruption and minimising possible damage.
3. Lumen Homes is liable for items brought in by the guest in accordance with the statutory provisions. If the guest wishes to store money, securities or valuables worth more than €800 or other items worth more than €2000 at Lumen Homes, a separate agreement is required.
4. if a parking space is made available to the guest, this does not constitute a safekeeping contract. Lumen Homes is not liable for the loss of or damage to vehicles, trailers and their contents, motorbikes or caravans parked or manoeuvred on the property, unless the damage is due to intent or gross negligence on the part of Lumen Homes.

V. Pets
Pets are not permitted unless Lumen Homes has explicitly granted the guest an exception in writing.

VI. Termination of the accommodation contract by Lumen Homes
1. Lumen Homes has the right to withdraw from the accommodation contract if the guest fails to make the advance payment owed (see Section III.2. of these terms and conditions) or a deposit due on time or in full.
2. Lumen Homes may terminate the accommodation contract if the guest is under the influence of illegal drugs during their stay, uses the rooms for commercial activities with customer traffic, uses the rooms for prostitution or repeatedly insults the staff despite warnings. In addition, Lumen Homes has the right to terminate the contract if insolvency proceedings are opened against the guest's assets or rejected due to lack of assets. A further right of termination exists if the guest could endanger the smooth operation, safety or public reputation of Lumen Homes without this being attributable to the area of responsibility or organisation of Lumen Homes.
3. Lumen Homes has the right to withdraw from the accommodation contract if a) it is not possible for Lumen Homes to provide the accommodation service because the accommodation rooms are not in the required technical condition due to an unforeseen event (e.g. burst water pipe, heating failure, fire) and if b) it would not be possible for Lumen Homes to accommodate the guest in equivalent alternative accommodation or only at a cost that exceeds the total accommodation price paid by the guest by more than 20%  for the affected period in which damage exists. The fulfilment of the condition formulated under a) shall immediately constitute Lumen Homes' claim that the guest agrees to accommodation in equivalent alternative accommodation.


VII. Data protection
1. the guest is informed that his/her personal data will be stored and processed by Lumen Homes for the execution of the contract, for customer service and for advertising purposes and will be passed on to affiliated companies and selected external service providers.
2. Lumen Homes is authorised to forward personal data in accordance with this section to affiliated companies and selected service providers in order to have it stored and processed there.
3. the guest has a right to information in accordance with § 15 GDPR. They can object to the use of their personal data for advertising purposes at any time and thus revoke their consent.
4. The guest retains the right to information, correction, blocking or deletion of the personal data stored by Lumen Homes, provided that there are no legal provisions to the contrary. Provided that there are no legal provisions to the contrary, the personal data will be deleted after termination of the accommodation contract and after expiry of the statutory retention periods.

VIII. Final provisions
1. amendments and additions to the contract or these general terms and conditions should be made in writing. Unilateral amendments by the guest are invalid. Should any provision of these terms and conditions be or become invalid, this shall not affect the validity of the remaining provisions.
2. place of fulfilment, place of payment and exclusive place of jurisdiction is, as far as legally permissible, the registered office of Lumen Homes.
3. the law of the Federal Republic of Germany shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
4. the invalidity of one or more of the above provisions shall not affect the validity of the remaining provisions.




House Rules


1. Check-In is at 15:00, Check-Out is at 11:00. Early check-in or late checkout may be available upon request. Guests who stay beyond their designated checkout time or delay our housekeeping staff are liable for any associated costs and expenses.
2. Guests are not allowed to make a reservation in their city of residence. Please contact us if you're booking within your city.
3. Smoking indoors, parties, and excessive noise are not allowed, including on balconies and in shared spaces. Smoking violations are subject to a €300 fine plus the cost to clean, deodorize, and repair damages. Smoking on the balcony is allowed. Cigarettes are to be disposed of in the ashtray provided. Cigarettes are not to be thrown in the garden downstairs (fire hazard!). Cigarettes thrown in the garden downstairs will be disposed of at a charge (€300 penalty plus compensation of damages – to be paid by the guest). In the event of excessive noise development/parties, a security service will be called and the house rules will be enforced. The guest pays the cost of the operation and an additional penalty fee of €800. In addition, the guest must compensate for any damage incurred (the replacement value applies here). Night rest (silence) between 10:00 p.m. and 7:00 a.m.!
4. Commercial photography/videography without written consent and Illegal activity is strictly prohibited.
5. Overnight guests that exceed the number stated in the reservation are not allowed. We charge €30 per night for each additional guest.
6. Pets are not allowed. Violation of our pet policy may result in a fine. We encourage guests with service animals to contact us before their stay.
7. Guests are responsible for covering the cost to replace lost keys, key cards, fobs, or parking passes.
8. Noise detecting technology may be used inside the apartment to monitor excessive noise levels. Video surveillance may be used in outside and common areas.
9. Cars must be parked in the garage, if a parking space is booked. It is forbidden to park on the property outside the garage.
10. Guests take full responsibility for damages, injury, or loss that occur on the premises and its facilities. Guests must report any property damage to customer service.


General terms and conditions for internet use

§ 1 Internet use and terms
Lumen Homes provides its guests with free Internet access via a Wi-Fi network. The network can only be used using the access data provided by Lumen Homes. Please note that this service does not include the provision of a firewall or a program to protect against malicious computer programs.
A guest is any user of the Wi-Fi network who is accommodated by Lumen Homes for a fee or free of charge. Anyone who uses the guest's system with the guest's approval is also considered a guest. The guest's system is understood to mean the entirety of the computer hardware and software used by the guest to use the service offered.

§ 2 Behavior
(1) The guest may not select any websites that contain criminally relevant content, in particular pages with child pornography, content that glorifies violence or incitement to hatred, pages that incite crimes or are likely to seriously endanger children or young people.
(2) The guest must ensure that when using the WiFi network, no files are downloaded or distributed that infringe third-party copyrights. Particularly when using file sharing platforms, the guest must respect the copyrights of third parties. In cases of doubt, the guest should refrain from downloading or distributing such files and obtain further information about the files.

§ 3 Liability
(1) Lumen Homes is not liable for damage to the guest's system caused by the use of the WiFi network, in particular as a result of visiting third-party websites.
(2) If Lumen Homes is exposed to claims from third parties as a result of non-compliance with the above regulations, in particular § 2, Lumen Homes must be released from such claims by the guest.
